1. Welcome

These Terms of Service ("Terms") govern your use of the Breathe Easy Balm website, mobile app, and related services (together, the "Service"), operated by Breathe Easy Balm ("we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. Not medical advice

Breathe Easy Balm is a companion app for emotional regulation, habit substitution, and mindful moments. It is not a medical device, treatment, or substitute for professional care. Content, wellness prompts, breathing exercises, and milestone information are for general wellness and informational purposes only. If you are quitting nicotine or managing a health condition, please consult a qualified healthcare provider. In an emergency, call your local emergency number.

3. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may only use the Service with the involvement of a parent or legal guardian.

4. Accounts

Some features require an account. You are responsible for keeping your login credentials confidential and for activity on your account. Notify us promptly if you suspect unauthorized use.

5. Purchases

The Breathe Easy app and membership are free — there is no subscription and nothing to cancel. The Service offers physical goods for purchase (lip balm). Physical orders are fulfilled through our storefront and subject to its shipping and returns policies.

6. Refunds

For questions about a lip balm order or a return, contact us at /contact. Physical product returns follow the policy stated at checkout.

7. Your content

You may submit content to the Service, including journal entries, favorites, uploaded background photos, community thoughts, and support messages ("User Content"). You retain ownership of your User Content. By submitting it, you grant us a limited, non-exclusive license to store, display, and process it as needed to operate the Service.

You agree not to submit content that is illegal, hateful, harassing, sexually explicit, or otherwise inappropriate. Uploaded photos are screened by an on-device content filter; photos that appear to violate our G-rated policy are automatically removed. We may also remove any content at our discretion.

8. Acceptable use

You agree not to:

• use the Service to break the law or infringe others' rights;
• attempt to access accounts, data, or systems that aren't yours;
• interfere with, disrupt, or reverse-engineer the Service;
• submit malware, spam, or automated abuse;
• impersonate anyone or misrepresent your affiliation.

9. Intellectual property

The Service, including its design, code, illustrations, and original text, is owned by us or our licensors and protected by intellectual property laws. Encouragement messages in Breathe Easy Balm are original wellness prompts and are not intended to reproduce third-party quotations or copyrighted works. Please contact us regarding any intellectual-property concern. Intentionally selected scripture is separate sourced material and is clearly identified with its exact reference and a source link when practical.

10. Third-party services

The Service integrates with third parties (for example, Google Sign-In, our payment processor, and our storefront). Your use of those services is governed by their own terms and privacy policies.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that any specific outcome (health, emotional, or otherwise) will result from its use. Results may vary.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) US$50.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive (ownership, disclaimers, limitations of liability, dispute resolution) will survive termination.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Effective" date above. Material changes will be highlighted in the app or by other reasonable means. Continued use of the Service after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the United States and the state in which we operate, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to informal resolution.
